SUPREME COURT OF APPEAL (SCA) DISMISSES APPLICATION BY ML A S DESAI
The Gauteng Division of the High Court of South Africa handed down an order on 24 March 2016, in which it held inter alia that the trademark “United Ulama Council of South Africa” registered by Moulana A S Desai had indeed been registered mala fide (with intent to deceive) and must be removed from the Register of Trade Marks.
Ml A S Desai then applied to the High Court for leave to appeal which was turned down by the presiding judge on the 17th May 2017. The application for leave to appeal was dismissed with costs.
He then petitioned the Supreme Court of Appeal (SCA) for leave to appeal, which the SCA has dismissed on the 28th November 2017 with costs, stating that there is ‘no reasonable prospect of success in an appeal and there is no other compelling reason why an appeal should be heard.’
Despite the victory for UUCSA, we do not bask in the glory of the victor, but painfully lament the dogged insistence of Ml A S Desai in fighting endless court battles instead of constructively dealing with vexing issues that threaten the very existence of Islam and Muslims both locally and internationally.
We trust that Ml A S Desai will now finally abort his ill-conceived attempt to feign who he is not and accept that he did register the name with INTENT TO DECEIVE!
